    FCC Implements Junk Fax Prevention Act of 2005

    The Federal Communications Commission has announced its rules to implement the Junk Fax Prevention Act of 2005. In accordance with the act, it will allow faxes to be sent to parties with whom the sender has an established business relationship. It also mandates that a clear and conspicuous notice be placed on the first page of the fax providing direction on how to “opt-out” of future communications. Senders must honor opt-out requests within 30 days. However, the new rules do not provide an exception for small businesses or non-profit trade associations from the rules.
