INTRODUCTIONS AND OPENING REMARKS (10:00 – 10:15 a.m.)

I.    UPDATE FROM WASHINGTON (10:15 – 11:00 a.m.)
Congress has a number of important issues left to resolve before they head back to their districts for the August recess. Major tax reform is looking less likely this year, but the threat to the advertising deduction may arise as Congress seeks funding for other major priorities, such as the Highway Trust Fund. Legislation to combat so-called “patent trolls” looks more likely to pass in some form this year. Federal data security legislation continues to be pending and the states remain very active on this front. Meanwhile, controversies continue to surround ICANN’s delegation of new TLDs, especially .sucks. ANA’s Dan Jaffe will cover what you can expect in Washington and the states as we head into the second half of 2015 and the upcoming Presidential nominating marathon.

II.    MARRIED TO THE MOB:  USING CROWDSOURCED DATA AS SUBSTANTIATION (11:00 a.m. – 12:00 p.m.)
When consumers post reviews, interact with social media platforms and websites, and use applications and other technology, a staggering amount of data is collected. In this session we will explore when, and how, can you use this data to create and substantiate advertising claims. We will review the latest NAD decisions and guidance from the FTC, and, since the session will be interactive, tap into the unmatched wisdom of the “mob” of attendees.

During lunch, we will hold a member roundtable discussion on issues of concern to the committee:

  • Upcoming ANA Advertising Law & Public Policy Conference

III.    SOCIAL MEDIA 2.0 (1:00 – 2:00 p.m.)
This session will offer an overview of key legal issues to be aware of with regard to advertising with a focus on basic advertising rules, common advertising techniques and intellectual property issues. Part two will review the current status of the world of social media looking back at major campaigns and issues from the past year. It will further discuss some of the key intellectual property issues raised by social media.
