Drug Safety Bill on Senate Floor Next Week

We have learned that the Senate leadership is likely to bring up the drug safety bill (S.1082) as early as next Monday. 

This bill contains provisions that are an enormous threat to the advertising community.  The legislation allows the FDA to ban new prescription drugs ads for up to 2 years and imposes significant new disclosure requirements. 

If these additional restrictions can be imposed on prescription drug advertising, which is already one of the most restricted areas of advertising in the United States, this will create serious and dangerous precedents for all other advertising categories that are not as comprehensively regulated. 

Senator Pat Roberts (R-KS) will offer an amendment to strike the provisions.  Please contact Senate offices to request that they support the amendment.  Time is of the essence.
