Congressman Markey Introduces Mobile Privacy Act

Congressman Ed Markey (D-MA), the co-Chair of the Congressional Privacy Caucus, has introduced legislation that would require companies to disclose to consumers the capability to monitor telephone usage and to obtain express consent from consumers prior to monitoring. Rep. Diana DeGette (D-CO) has signed on as a co-sponsor of Markey’s legislation, the Mobile Device Privacy Act (H.R. 6377).  

The bill also sets requirements for what must be included in the disclosure and requires those engaged in monitoring to have security policies in place to protect consumer data. The FTC and FCC are given shared enforcement powers with state attorneys general for violations of the law.
