INTRODUCTIONS/OPENING REMARKS (10:00 – 10:15 a.m.)

I.    CURRENT EVENTS IN COMMERCIAL SPEECH (10:15 – 10:45 a.m.)
Ronnie London
of Davis Wright Tremaine LLP will address current First Amendment commercial speech issues, including the ongoing effort to expand required disclosures under Zauderer v. Office of Disciplinary Counsel and Milavetz, Gallop & Milavetz v. U.S., and more recent cases like American Meat Institute v. USDA, such as those in Northern California and Baltimore pertaining to sugar-sweetened beverages and cell phones. Discussion will also include potential application of the Supreme Court’s 2015 decision in Reed v. Town of Gilbert to commercial speech, and cases the Court recently accepted for review involving the constitutionality of the Trademark Act’s ban on registering “disparaging marks” and of restrictions on conveying price information relating to the use of credit cards.

II.    WASHINGTON UPDATE AND 2017 AD LAW CONFERENCE DISCUSSION (10:45 – 11:15 a.m.)
The election of 2016 is entering its home stretch – but what matters more is what happens after a Clinton or Trump win. Who will control Congress and what does that mean for the advertising industry? What issues will rise to the top in 2017? Meanwhile, we have been dealing with a more active FCC, so what’s next from the Commission and how will they interact with the FTC? ANA’s Dan Jaffe will provide a breakdown of what you need to know to navigate the current political climate. 

We also plan on having an open discussion about the upcoming 2017 ANA Advertising Law & Public Policy Conference.  Please bring your ideas for potential topics you would like us to cover and possible speakers you think would be a good addition to the agenda.

III.    NEXT STEPS ON MEDIA TRANSPARENCY (11:15 a.m. – 12:00 p.m.) 
Keri Bruce of Reed Smith LLP will discuss what we’ve learned in the months since the K2 Intelligence report revealed a fundamental disconnect in the advertising industry about the basic nature of the advertiser/agency relationship. How are your fellow advertisers responding and what’s next?

IV.    ADVERTISING DISCLOSURES AND THE FTC (12:30 – 1:15 p.m.)

Advertisers face continued scrutiny over disclosures under the FTC Endorsement Guides and the number of enforcement actions has increased. The question for advertisers is whether all parties understand their obligations and whether more can be done to educate agency, networks and influencers on proper disclosures. What more can be done to make disclosure best practices better understood and how can we as advertisers ask social media platforms to help enable easily understood disclosures? Cassidy Sehgal of L'Oreal USA will lead this discussion.

V.    NATIVE ADVERTISING/BRAND AMBASSADOR BENCHMARKING DISCUSSION (1:15 – 2:00 p.m.)
