ANA Hails Court Ruling Blocking HHS Price Disclosure Rule

ANA HAILS COURT RULING BLOCKING HHS PRICE DISCLOSURE RULE  

WASHINGTON, D.C. (JULY 9, 2019) – ANA strongly supports yesterday’s ruling of the United States District Court for the District of Columbia striking down the proposed Health and Human Services (HHS) rule to mandate price disclosures in most prescription drug ads. ANA joined with Merck, Amgen, and Eli Lilly in suing in opposition to the rule. The court found that Congress had not provided HHS the authority to impose the rule. 

Dan Jaffe, ANA’s Group Executive Vice President for Government Relations, stated, “This decision was an important victory for the public and the advertising community. The rule required price disclosures that would have been highly inflated, misleading and inaccurate for a vast number of consumers.” 

Jaffe emphasized that, “The rule clearly violates the First Amendment and would not further the goal of lowering prescription drug prices, while creating broad adverse precedents extending far beyond the prescription drug area.” 

Jaffe concluded, “ANA will continue to vigorously uphold the vital First Amendment rights of the advertising community.”
