FTC Rulemaking and Why It Matters

The FTC is looking to create new rules and change existing ones in a tsunami of newly announced rulemakings. Think FTC Rulemaking is a wonky Washington thing? It is - but it is also a top priority of the FTC and will change the way your clients conduct business. It has announced its plans to implement rules around targeted advertising, subscription plans, disclosures/reviews, add-on fees, and non-competes. These rules will take over the more flexible business guidance we have relied on from the FTC and will be difficult to adjust once implemented. In addition, rule violations beget significant penalties. While rulemaking does not happen overnight, it is nuanced and complex, involving opportunities to comment and participate in hearings. Companies must understand the process to assess when and how to engage with the agency on specific issues. Join us as we provide an overview of the different FTC rulemaking processes (and guide reviews) and discuss how and when companies should consider engaging. The goal of this panel is not to revisit your Administrative Law Class but to make you feel confident to alert your clients to what is happening in D.C. and how to affect the process to protect your business or industry.
