Programmatic advertising promises a better match between ad and viewer by drawing upon large sets of data, some of which  may be in real-time. Regulators have suggested that the use of big data practices in advertising can result in harm to consumers, particularly if used for discriminatory purposes.  Consumer class action litigation and vendor management issues can also give rise to legal risks. In this presentation, Cassidy Sehgal, Vice President, Advertising and Digital Media Counsel from L’Oreal USA, and Paul Bond, Partner at Reed Smith LLP, will identify the potential regulatory and legal pitfalls with programmatic advertising while also offering some key takeaways and concrete recommendations on how to navigate the increasingly important programmatic advertising environment.

EU, PRIVACY, AND THE RIGHT TO BE FORGOTTEN (4:00 - 4:45 p.m.)
This discussion, facilitated by members of the Global Advertising Lawyers Alliance (GALA) will provide an overview of EU directives and regulations and national stipulations on privacy. Data privacy in Germany and its effects on direct marketing will be explored in depth, as will the EU’s draft regulation on data protection in light of the challenges posed by big data. It will conclude with a discussion of the European Court of Justice’s Right to Be Forgotten decision and the approaches in response to the decision being followed in both France and Germany.
