ANA Regulatory Working Group: Green Guides

The FTC recently announced a review of its Guides for the Use of Environmental Marketing Claims (the Green Guides). The review was announced according to the FTC’s decennial review schedule and seeks comments on the efficiency, costs, benefits, and regulatory impact of the Guides to determine if they should be retained, modified, or rescinded.

  • The FTC flagged a number of issues for comment, including:
  • Is there a need for the guides?
  • What benefits have they provided to consumers?
  • Should they be modified?
  • Are there international laws, regulations, or standards the FTC should consider?
  • Should the FTC issue a rulemaking relating to deceptive or unfair environmental claims?

It also seeks comments on specific claims, including on carbon offsets, compostability, degradability, and recyclability, among others.

Comments are due on February 21, 2023 and ANA plans on filing comments. This meeting is to discuss an outline of our comments and solicit input from our members on the FTC request.
