WELCOME AND INTRODUCTIONS (2:00 – 2:15 pm)

I.    A SELF-REGULATORY RECAP (2:15 – 3:00 pm)
Lee Peeler of the Advertising Self-Regulatory Council (ASRC) will provide a recap of 2016's self-regulatory activity and lessons learned. Discussion will center on the advantages that the NAD process has over litigation, meeting the challenges of ethical marketing to children in the digital era, and the key role of compliance with DAA principles in promoting the ethical use of interest based advertising.

II.    DISGORGEMENT AS A REMEDY UNDER THE LANHAM ACT (3:00 – 3:45 pm)
Larry Weinstein,
co-chair of the Advertising Law practice at Proskauer Rose, will be discussing the remedy of disgorgement of profits in Lanham Act false advertising cases. An ANA member has inquired about this issue, and Larry will address the circumstances in which disgorgement is an available remedy for false advertising, how that remedy came to be, the rationale behind it, and in what circumstances can disgorgement be awarded.

III.    MEET THE NEW BCP DIRECTOR (3:45 – 4:30 pm)
Tom Pahl started as the new director of the Bureau of Consumer Protection at the FTC just a few weeks ago. This will be one of the first opportunities to hear from him and learn about his investigation and enforcement priorities relating to the advertising industry going forward.

IV.    SAG/AFTRA AND AFM UPDATES (4:30 – 5:00 pm)
Stacy Marcus will give an update on three key areas of focus for the JPC and SAG-AFTRA for 2017, as well as an update on the upcoming expiration of the Jingles Contract with the American Federation of Musicians.
