LEGAL & REGULATORY SERIES: The Federal Agenda on Advertising: The FTC and CFPB

The FTC kicked off 2016 with an ambitious privacy agenda. Per the agency, behavioral advertising has grown exponentially in even the last few years, but consumer understanding has been slow to change. The FTC is taking aim at the resulting “information asymmetry” with all the tools at its disposal. Paul Bond will provide an update on this current FTC push for online transparency, increased self-regulation, and greater advertiser attention to privacy-enhancing technologies.

Some advertisers have the additional challenge of meeting the expectations of financial regulators. Nicholas Smyth will discuss recent Consumer Financial Protection Bureau (CFPB) cases involving allegations of deceptive or otherwise illegal advertising, explain how the CFPB approaches advertising, and predict what practices the CFPB will be targeting next.
