I. THE FUTURE OF THE COMMERCIAL SPEECH DOCTRINE (10:15 - 11:00 a.m.)
What is the current state of the commercial speech doctrine? After last year's Supreme Court ruling in Reed v. Town of Gilbert, lawyers have been debating whether any content-based regulation must satisfy strict scrutiny, including regulations that target commercial speech. This discussion is taking place as some courts have applied a type of stricter review to regulations that discriminate against commercial speakers. Yet just as it may appear that commercial speech is acquiring stronger First Amendment protection, other courts have approved a more lenient test for requirements that commercial speakers convey government-mandated warnings or disclosures. What are the current trends for commercial speech in the courts and how do they affect advertisers?
