III. CCPA Data Broker Regulations: Discussion (3:35 - 4:05 pm)
Under the CCPA Data Broker regulations that came into effect on December 27, 2024, the CPPA has defined “direct relationship,” providing that “A business is still a data broker if it has a direct relationship with a consumer but also sells personal information about the consumer that the business did not collect directly from the consumer.” A likely example of this is where a brand or its agency appends third-party data to the brand’s consumer profiles, and the appended third-party data is included in a dataset shared with a third party for targeted advertising purposes, resulting in a sale/share. It seems unlikely that brands and advertisers will be jumping to register as data brokers in California in response to this. It seems clear, though, what the agency is after here. We'd like to hear the perspective of our members on this.
