BREAKOUT 4C: GREEN, GREENWASHED, OR GREENHUSHED? NAVIGATING ENVIRONMENTAL BENEFIT CLAIMS IN MARKETING

As brands continue to promote their products as "sustainable," "recyclable," and "eco-friendly," green marketing claims have become a lightning rod for regulators, plaintiffs' lawyers, and skeptical consumers. With long-awaited updates to the FTC Green Guides still pending, new state-level legislation on the rise, and false advertising litigation mounting, companies face unprecedented risk when making environmental claims. This session will provide practical guidance for safely navigating the evolving green marketing landscape, including:

  • Greenwashing Litigation: From "recyclable" packaging and "carbon neutral" pledges to "sustainably sourced" products, class actions and competitor challenges targeting green claims are surging. Not all case decisions are consistent, so this panel will offer strategies to apply them to proposed claims.
  • The Patchwork of New State Laws and Enforcement: State legislatures and attorneys general have increased their focus on these issues, passing new laws and using a range of statutes and common law to seek significant injunctive and monetary relief.
  • Building a Defensible Green Claim: Practical strategies for substantiating recyclable, sustainable, and net zero claims, including how to use third-party certifications effectively, when and how to qualify broad environmental benefit claims, and what "competent and reliable" evidence looks like in today's enforcement environment.

BREAKOUT 8A: WHEN ADVERTISING CROSSES THE LINE: A GLOBAL PERSPECTIVE ON CONTROVERSIAL CAMPAIGNS

Advertising has always walked a fine line between creativity and controversy. Across jurisdictions worldwide, campaigns that captivate audiences in one market may provoke outrage, regulatory intervention, or outright prohibition in another. This session, presented by lawyers from the Global Advertising Lawyers Alliance, offers a lively and participatory exploration of advertisements that have sparked the fiercest debate. Rather than a conventional panel discussion, the panelists will view a curated selection of the most contentious commercials from around the globe, before examining the legal frameworks, cultural expectations, and regulatory responses that determined their fate.
The advertisements under discussion will engage with a broad spectrum of issues that regularly test the limits of advertising standards, including:

  • Nudity in advertising and the thresholds of acceptability across different cultures
  • The objectification of women and the sexualization of minors
  • Gender stereotyping and evolving regulatory approaches to its portrayal
  • Racial discrimination and the perpetuation of ethnic stereotypes
  • Portrayals of people with disabilities, both positive and negative, and questions of dignity and representation
  • References to the lesbian, gay, bisexual and transgender community and varying societal attitudes
  • Sensitivities surrounding religious imagery, belief, and iconography in marketing
