Many marketers are rightfully confused by the maze of federal and state regulations around cannabis and CBD (cannabidiol, a component of the cannabis plant typically sold as CBD oil — and also increasingly infused in various products advertised to consumers). Cori Goldberg and Jillian Petrera of Reed Smith LLP provided a regulatory, enforcement, and litigation update on where things stand in this rapidly developing industry. This presentation offered a discussion of recent Food and Drug Administration (FDA) and Federal Trade Commission (FTC) enforcement actions, along with state and federal litigation.
