MIDWAY BUZZ: INFLUENCER VS. CELEBRITY ENDORSEMENTS

Where is the line between an influencer marketing arrangement and a talent agreement? When does a creator become a celebrity endorser, and what changes once that line is crossed?

This session will examine the tipping point between deals that fit a more traditional influencer marketing agreement structure and those that fit better into a celebrity endorser or talent deal. We will look at how deal structure and contract terms like content control, approval rights, compensation, use rights, and disclosure obligations might be impacted. The panel will walk through core frameworks for each model and the factors that can shift an arrangement from one category to the other, with a focus on borderline scenarios where the answer is not clear-cut. Participants will come away with a practical set of considerations for evaluating these relationships and structuring agreements that reflect the intended role.
