Recent enforcement actions have demonstrated that enforcement agencies are now conducting deep-dive technical audits of businesses to determine compliance with applicable law. Plaintiff’s firms are also conducting similar automated technical audits to identify tracking technologies and misconfigured banners, to support allegations that these practices amount to illegal wiretapping – and therefore a basis for thousands of demand letters.
