The start of 2021 has seen some of the highest profile sales of non-fungible tokens (NFTs) and propelled NFTs to the forefront of public consideration. Individuals and businesses participating and operating in this space, whether in connection with issuing NFTs, operating an NFT marketplace, negotiating NFT investments, or engaging in NFT portfolio development, should carefully evaluate the legal implications of their operations. 

The laws surrounding NFTs are not yet well-developed and there is a good degree of regulatory uncertainty in the industry. In this webinar, we will explore legal and regulatory considerations applicable to NFTs including those involving money transmission, securities, commodities, advertising and media, corporate, tax, consumer protection, intellectual property, and cybersecurity and privacy law.

Michelle Gitlitz is the Global Head of Crowell & Moring’s Blockchain and Digital Assets practice, co-leads Crowell & Moring's Financial Services Practice, and is a partner in the White Collar and Regulatory Enforcement and Corporate groups. She is located in the firm’s New York office. 

An experienced regulatory lawyer and litigator, Michelle’s practice focuses on the legal and regulatory issues facing both emerging and established companies that invest in and incorporate blockchain technology and digital assets into their businesses. Her experience includes advising clients on the legal, regulatory, and risk management issues surrounding coin/token offerings (including launching new offerings and remediating prior offerings); working with clients in connection with digital currency exchanges and platforms; establishing new blockchains and nodes; and advising clients on navigating federal and state money transmission laws.

Michel C. Narganes is a partner in the Corporate Group and a resident in the firm's San Francisco office. With over 15 years of experience as a corporate attorney, she brings a wealth of experience specializing in venture-backed startups, corporate law, mergers and acquisitions, financings, commercial transactions, and licensing.

Prior to joining the firm, she was in-house counsel at a technology company providing support to grow and scale their domestic and international M&A, strategic partnerships and corporate compliance operations. During her tenure, she managed legal providers across professional services networks and advised the company on advanced transactions.
