Topic: Game Changing FTC Developments That You Need To Know About

The FTC just held a workshop on Dark Patterns, including manipulative user interface design, intentional or unintentional, on web site sites and mobile apps. What laws, rules or norms do they involve and how will they be regulated going forward?  The Supreme Court recently came down with a 9-0 decision in AMC Capital Management vs. FTC holding that Section 13 (b) of the FTC Act does not authorize awarding damages for consumer injury, including restitution. The scene shifts to Congress and possible significant law changes, how will these affect your practice and business?

Linda Goldstein, Partner, Co-leader of BakerHostetler’s Advertising, Marketing and Digital Media team, Linda Goldstein is widely recognized as one of the leading advertising lawyers in the country. She regularly provides advertising counsel and regulatory advice to leading Fortune 500 and Fortune 100 companies in many different product and service categories, including telecommunications, wireless, retailing, publishing, entertainment, digital media, gaming, food and beverage, and financial services.

Goldstein represents clients in investigative and enforcement proceedings brought by the Federal Trade Commission, state attorneys general, district attorneys, and other federal and state agencies with jurisdiction over advertising and marketing practices, and she has handled some of the highest-profile matters, setting industry precedents. Immersed in all aspects of the digital media ecosystem, Linda spends much of her time advising clients on how to minimize the legal risks associated with mobile marketing, e-retail, online communities, social influencers, native advertising, email and telemarketing, sweepstakes and contests, fantasy sports leagues, and casual gaming. Mark DeLaquil, Partner, is an experienced advocate who focuses on appellate practice, complex environmental and regulatory proceedings, and political law. DeLaquil has represented state and private clients in Clean Air Act administrative proceedings and litigation, including preparing comments on proposed actions and contesting them in courts of appeals. Has extensive experience in actions concerning climate change, air quality standards, emission standards, preconstruction and operating permits, and state implementation plans. He has represented parties in appeals throughout the United States and argued numerous appeals in the Second, Seventh, Eighth, Ninth, and District of Columbia Circuits. Represented clients in a full array of campaign finance matters, from counseling compliance to successfully challenging the enforcement of state campaign finance law.
