Advertising Industry Strongly Opposes Proposed Florida Privacy Legislation

Advertising Industry Strongly Opposes Proposed Florida Privacy Legislation

Washington D.C. (April 22, 2021) – On Tuesday, the nation’s leading advertising and marketing trade associations sent a letter to the Florida Senate in opposition to SB 1734 and HB 969, the proposed legislation to regulate data. If passed, the bills would “fall short of establishing effective or practical privacy standards for Florida consumers while creating substantial compliance costs and straining precious resources for Florida businesses at a time when they are still coming back from disruptions caused by the COVID-19 pandemic.” 

The Association of National Advertisers, 4A’s, Interactive Advertising Bureau, American Advertising Federation, Network Advertising Initiative, American Advertising Federation – Orlando and American Advertising Federation – Tampa Bay signed the letter. The trades oppose this bill, because if enacted, the bill would create the most onerous and costly privacy requirements in the United States, make Florida the least business-friendly state in the country; and, fail to provide workable or effective privacy protections for Floridians.

The organizations also raised that the bills should not include a private right of action, should not permit others to exercise Floridians’ privacy rights, should provide sufficient time for businesses to act on opt-out requests and the deletion right should be harmonized with other state laws. 

“More time is needed to refine the bills so they can create practical privacy standards for Florida consumers, without unnecessarily threatening critical Florida industries. The legislature should not pass SB 1734 or HB 969 in the closing days of this legislative session. We stand ready to work with you to achieve privacy reform that works for all Floridians in 2022,” said the signed groups.
