June’s topic will be Endorsement Contracts in the #METOO Era: A discussion of current issues and trends when contracting with talent, including morals clauses, inclusion riders, managing overzealous endorsers and social media activity outside the contract. Presenting from Davis & Gilbert will be James L. Johnson, Partner, Entertainment, Media & Sports and Samantha G. Rothaus, Associate, Entertainment, Media & Sports.
James L. Johnston is a partner in the Entertainment, Media & Sports; Digital Media, Technology & Privacy; Advertising, Marketing & Promotions and Intellectual Property Practice Groups of Davis & Gilbert. Mr. Johnston represents numerous multinational, national and local media companies, sports leagues and teams, television and motion picture producers, marketing and promotions agencies, and advertisers in connection with all aspects of the sports, motion picture, television, entertainment, advertising, promotions, and marketing industries.
Mr. Johnston has considerable experience in all aspects of sports, entertainment, new media and advertising law. In the sports field, his practice touches on businesses and individuals of all types whose interests intersect with the sports industry. Mr. Johnston has advised professional sports leagues and governing bodies on broadcast and other media rights, sponsorships and licensing relationships. His work includes counseling clients on stadium naming rights, team and league sponsorships, and multiplatform sports marketing agreements. Mr. Johnston’s practice also involves advising global ticketing services, merchandise licensees and other businesses which support the sports industry.
Samantha G. Rothaus is an associate in the Advertising, Marketing & Promotions; Entertainment, Media & Sports and Intellectual Property Practice Groups of Davis & Gilbert. She represents advertising, communications and public relations agencies, media and production companies, filmmakers and advertisers in connection with a variety of issues in advertising, marketing, intellectual property, media and entertainment law. Ms. Rothaus' practice includes reviewing advertising content (both branded and native) in a variety of media, as well as advising clients on complex intellectual property, false advertising and consumer protection matters. In addition, her practice includes preparing and negotiating the documents necessary for any creative execution or branded promotion, such as talent and influencer agreements, sponsorship agreements, software and other intellectual property licenses, sweepstakes and contest rules and related contracts.
Ms. Rothaus also has extensive experience in brand protection and brand management, notably in the fashion and lifestyle industries, and she continues to assist clients in asserting and defending their intellectual property rights against competitors and other third parties. As a former litigator with experience in federal and state courts, as well as in the U.S. Patent and Trademark Office and the World Intellectual Property Organization, she is well-versed in the many stages of both formal and informal dispute resolution processes, allowing her to provide strategic advice to clients to protect their business interests. She is passionate about the arts and entertainment and regularly provides pro bono assistance to independent artists, including filmmakers and musicians, through organizations such as Volunteer Lawyers for the Arts.
